In a decisive move to protect American taxpayers, the Trump administration has revoked a Clinton-era policy that allowed illegal immigrants to access federal healthcare and welfare programs. The Department of Health and Human Services (HHS) announced Thursday that it will now strictly enforce the 1996 Personal Responsibility and Work Opportunity Reconciliation Act (PRWORA), reserving benefits like Head Start, health clinics, and aid grants exclusively for U.S. citizens.
The policy reversal, part of President Trump’s broader immigration enforcement agenda, marks a crucial step toward prioritizing American families and upholding legal integrity in federally funded programs. HHS estimates the change will redirect up to $374 million annually back to U.S. citizens.
For decades, illegal immigrants benefited from taxpayer-funded services under a 1998 interpretation of PRWORA, which expanded eligibility beyond what Congress intended. The Trump administration’s correction classifies programs like Head Start as “federal public benefits”, making them off-limits to those unlawfully present in the U.S.
“For too long, the government has diverted hardworking Americans’ tax dollars to incentivize illegal immigration,” said HHS Secretary Robert F. Kennedy, Jr. “Today’s action changes that – it restores integrity to federal social programs, enforces the rule of law, and protects vital resources for the American people.”
The policy follows Trump’s February 2025 executive order, “Ending Taxpayer Subsidization of Open Borders,” directing federal agencies to eliminate unlawful benefits for illegal immigrants. HHS has also shared Medicaid enrollment records, including immigration status, with Homeland Security to ensure compliance.
Among the most significant impacts is on Head Start, which provides early education and nutrition services to low-income families. Under the Clinton administration’s interpretation, illegal immigrants could enroll despite PRWORA’s intent. Now, estimated savings for American citizens could approach $374 million per year.
“Head Start’s classification under the new PRWORA interpretation puts American families first by ensuring taxpayer-funded benefits are reserved for eligible individuals,” said Andrew Gradison, Acting Assistant Secretary for Children and Families.
Programs like Community Health Centers and Mental Health Services Block Grants will also enforce stricter eligibility, ensuring federal dollars serve citizens, not those breaking immigration laws. The Education Department has taken similar steps, barring illegal aliens from career training and Pell Grant programs.
While the Trump administration tightens access at the federal level, Democrat-run states like California, Illinois, and Minnesota struggle with ballooning costs from illegal immigrant benefits. Budget shortfalls have forced these states to scale back programs that are proving to be unsustainable without federal subsidies.
Critics argue that unchecked welfare access incentivizes illegal immigration, burdening taxpayers. The Trump administration’s policy realigns with Congress’s original 1996 welfare reform goals, emphasizing self-sufficiency and legal residency requirements.
The HHS reversal corrects a 26-year-old error, closing loopholes that undermined PRWORA. Unlike the Clinton-era approach, the new policy definitively excludes illegal immigrants from federal aid, with exceptions only for emergencies like disaster relief.
Education Secretary Linda McMahon underscored the broader mission: “Hardworking American taxpayers will no longer foot the bill for illegal aliens.” By enforcing existing law, the administration ensures benefits go to those who play by the rules, not those who skip the line.
Thursday’s action reaffirms the Trump administration’s commitment to America-first policies. By rescinding the 1998 interpretation, HHS halts taxpayer-funded incentives for illegal immigration, directing billions back to citizens. This commonsense enforcement honors Congress’s original intent of protecting American resources while restoring fairness to federal programs.
